Judge Adjei-Frimpong emphasized that the sentencing regime’s numerous components are governed by statute, which restricts the judge’s ability to issue sentences.
Nonetheless, he contended that there are circumstances in which a fine may be imposed, and he cited an Article 30 clause that says the court may take into account imposing a fine unless there is a strong reason for a jail term.
He counseled judges, “I think we should have these provisions in mind as judges, especially those at the trial level, so that we don’t compound the problems of congestion in the prisons.”
