News Max was additionally charged by Smartmatic for allegedly “destroying relevant evidence” on purpose by removing senior officials’ emails and texts.

This “cover-up,” they said, was “carefully calculated” to prevent Smartmatic from ever seeing the information. They said that NewsMax CEO Chris Ruddy knew his 2020 texts should be preserved, but he allowed them to be erased.

In a court petition made public this week, Smartmatic stated, “Repeatedly, News Max has kept documents showing its actual malice and bad motive out of Smartmatic’s hands.”

“These were not unique errors. This was intentional. Important evidence that Newsmax has purposefully obliterated and hidden is detrimental to its position.

However, Newsmax responded on Friday, stating that the whole controversy around the recently discovered data is just “an attempt (by Smartmatic) to manufacture an issue where none exists.”

A "cover-up" is alleged by Smartmatic in a 2020 defamation lawsuit, but Newsmax denies removing evidence.
