Google sent Uncle Sam a $2 million payment to avoid going to trial by jury. A judge recently concurred.

In a blow to the Justice Department, Google's antitrust case will be determined by a judge – not a jury.

Google maintained that the $2.3 million check resolved the government’s claim for damages and that a jury was no longer required to try the issue, and Brinkema decided in the company’s favor.

Google spokesperson Peter Schottenfels praised Brinkema’s choice in a statement.

“The DOJ’s fabricated damages claim has crumbled. Schottenfels expressed his satisfaction that the Court decided to have a judge try the case. As we’ve already stated, this action is an unjustified attempt to select winners and losers in a fiercely competitive sector that has significantly boosted economic growth for companies of all kinds. We are eager to present our case in court.
